Mediation is a dynamic, structured, interactive process where a neutral third party (the mediator) assists parties in dispute resolve conflict through the use of communication and negotiation techniques. Participants appear voluntarily and are encouraged to actively engage in the process. Mediation is a "party-centered" process that is focused on listening and resolving conflict outside of the courtroom.

ConfidentialDiscussions during mediation are made on a "without prejudice" basis. This means what happens during mediation stays in mediation. Any discussions, admissions or settlement offer cannot be brought up in court, put in an affidavit or used as evidence in proceedings, unless both parties agree in writing.

CertaintyThe outcome of litigation can be uncertain and there is always a risk that a party will not be successful at trial. If the parties are able to resolve their matter through a negotiated settlement, the lawsuit is done. A settlement arrived at by the parties is often preferred to one decided by an individual judge or jury, because it puts the decision making in the hands of the parties themselves.

Further, it is a rule of the court that the successful litigant is awarded court costs as against the unsuccessful litigant.
